Your privacy is important to us.

Any personal data we receive from you as an applicant to the Order of Flemish Bars ("OVB") will be processed in accordance with applicable data protection regulations, in particular the General Data Protection Regulation 2016/679 of 27 April 2016 ("GDPR"), as well as this privacy notice.

This privacy notice provides you with more information about what personal data we process, why we process it, how we obtain it, how long we keep it and with whom we share it.

OBJECTIVES

We process your personal data for one or more of the following purposes:

  • Contact form;
  • Advertising;
  • Optimisation of the website; and
  • Dispute management.

Below, for each of these purposes, you can find out what personal data we process, why we process it, how we obtain it, how long we keep it and with whom we share it.

Contact form

With a view to providing the information requested via "Contact Advocaat.be" on the website, we may process your personal identification data (name, e-mail address) and/or any other data communicated to us (e.g. via your message).

These data allow us to provide the requested information via the contact form on the website and to follow up messages.

The legal basis for processing your personal data is based on your consent (art. 6, §1, (a) GDPR), which you have given us by using the contact form on the website. As regards the data of data subjects mentioned in the contact form, the legal basis is based on the legitimate interest to correctly execute the requested request (art. 6, §1, (f) GDPR).

We obtain your personal data either directly from you or indirectly from the data subject who filled in the contact form on the website.

For the purpose of delivering the requested information, we keep your personal data for 10 years after the follow-up of the contact (plus a verification period of 1 year).

Third parties with whom we work to store and manage our data have access to this personal data (IT/cloud providers).

Advertisements

If you use the option on the website to apply for the publication of an advertisement for a vacancy or internship position, we may process your personal identification data (name, (business) address, e-mail address, telephone number), financial data (bank account number, VAT number), information about your membership at one of the desks and information about your profession and job (office, position, place of employment, website) and/or any other information you provide in the context of placing this advertisement.

The processing of these personal data allows us, for example, to offer advertisements, such as "Offer your internship" or "Advertise your vacancy", via OrdeExpress, Advocaat.be and Privaat Liege.

The legal basis for processing these personal data is based on OVB's legitimate interest to fulfil its obligations under the agreement with the law firm (art. 6, §1, (f) GDPR).

We obtain this personal data directly from you when you complete the relevant forms (e.g. "Advertise your vacancy" or "Offer your internship").

As part of these advertisements, we keep your personal data for up to 10 years after the advertisement ends (plus a 1-year verification period).

We only share this personal data with third parties with whom we cooperate in the context of sponsorship (banks and insurance companies, external company auditor and accountant, accounting platform provider). In addition, third parties with whom we cooperate for the storage and management of our data also have access to this personal data (Diplad and (other) IT/cloud providers).

Optimisation of the website

With a view to optimising our website, we may process your electronic identification data (IP address and cookies).

This data allows us to offer a well-functioning and user-friendly website.

The legal basis for setting technically essential and functional cookies (e.g. to make the website function correctly or to provide a service requested by you) is the legitimate interest to offer a well-functioning and user-friendly website (art. 6, §1, (f) GDPR). Analytical, advertising and social media cookies (e.g. to improve the performance of the website via analytical cookies) are only set if you have consented to the setting of such cookies via the website (art. 6, §1, (a) GDPR) (for more information, see the Cookie Statement).

We always obtain your personal data directly from you.

The retention period varies for each cookie and you can change your cookie preferences at any time (for more information, see the Cookie Statement).

Third parties with whom we cooperate for the storage and management of our data have access to this personal data (IT/cloud providers). In addition, third-party cookie providers may also have access to your personal data.

Dispute management

For the purpose of managing possible disputes with website visitors, we may process your personal identification data (name, address, e-mail address, telephone number) and any other data relevant to the management of a (possible) dispute.

These data allow us to defend our legitimate interests in all forms of dispute resolution and to administer them.

The legal basis for processing your personal data is based on our legitimate interest to safeguard our (contractual and extra-contractual, legal and other) rights (Article 6, §1, (f) GDPR).

We obtain this personal data either directly from you or indirectly from third parties.

For dispute management purposes, we keep your personal data for up to 5 years after the expiry of the last deadline to appeal (longer if necessary, e.g. to comply with legal obligations) (plus a 1-year verification period).

We only share this personal data with third parties with whom we cooperate in the context of dispute management (external legal advisers) and with other parties if necessary (public authorities court and police services, bailiffs, debt collection agencies, banking and insurance institutions and our accounting firm). In addition, third parties with whom we cooperate for the storage and management of our data also have access to this personal data (IT/cloud providers).

SECURITY

We have implemented appropriate technical and organisational measures to ensure the confidentiality of your personal data and to protect your data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access.

We have entered into the necessary contractual arrangements with the third parties we work with and do not transfer your personal data outside the European Economic Area without ensuring that your data also enjoys an equivalent level of protection there.

RIGHTS

You can always contact us to exercise the following rights:

  • a request to access or rectify your personal data;
  • a request for erasure of your personal data;
  • a request to restrict the processing of your personal data;
  • - to withdraw your consent;
  • an objection to the processing of your personal data;
  • a complaint if you believe that we are not acting in accordance with applicable data protection legislation. You can also lodge a complaint with the Belgian Data Protection Authority.

You may at any time exercise your right to object to the processing of your personal data in the context of dispute management, stating the reasons relating to your specific situation. OVB will stop processing your personal data unless it considers that there are compelling legitimate grounds which outweigh the interests, rights and freedoms you claim.

For identification purposes, we may ask you for a copy of the front of your identity card.
