Do I have to go to court for every problem?

No, you don't have to go to court for every problem, quite the contrary. There are so many different solutions where court is often only the last step.

For example, you may choose to resolve your problem through mediation. A neutral person will help you and the other party reach a mutually acceptable solution. This way, you do not have to go to court. You record your agreements together in advance in a mediation agreement and you divide the costs of mediation between both parties.

In addition, you can also choose to solve your problem through collaborative negotiations. Unlike mediation, a collaborative negotiation does not involve a neutral third person. The participants in the collaborative negotiation are the parties and their own collaborative lawyers.

One or more experts may be called upon in this context to provide a neutral and objective report and advice, but that confidential advice is intended only to facilitate the search for a solution. Under no circumstances can the expert decide on the problem or solution.

Do I need a lawyer for this?

A lawyer can act as a mediator. Then he or she will help you reach an amicable agreement with the other party. By the way, a lawyer has undergone training for this if he or she indicates that he or she is a recognised mediator. Thus, an independent lawyer-mediator helps resolve your problems in a professional, confidential and voluntary manner.

To ensure the quality of collaborative negotiations, only collaborative lawyers are allowed to conduct collaborative negotiations. This sounds very logical. The collaborative lawyer is a lawyer registered on the list of collaborative lawyers maintained by the us as a profession. A collaborative lawyer, together with the other party's collaborative lawyer, tries to find 'creative solutions' in full transparency and bring the parties to an agreement. They are specially trained for this purpose.
