What is an environmental permit and how do you apply for one?
Suppose you’d like to build, renovate, subdivide your property or change the use of a building? In many cases, you’ll need what’s known as an environmental planning permission.
An environmental permit
For smaller projects, a simple notification may sometimes suffice, or you may even be granted an exemption. The rules that apply to your project depend on the nature of the works and also vary from one local authority to another. You should therefore be sure to check in advance which requirements apply to your situation. You can find information on this from your local authority.
For full details on the environmental permit, please contact the Flemish Government; there you’ll find step-by-step guidance on how to submit an application, tailored to your specific project or situation. You then submit an application for an environmental permit via the Omgevingsloket. Here, you will need to upload various documents, such as the building plans for your project.
Bear in mind that it may take several months before you hear whether your environmental permit has been granted. For large-scale projects, a public inquiry may need to be conducted. In most cases, it is the local authority that decides on your application, although larger projects may sometimes fall under the remit of the provincial or Flemish government.
Once your planning permission has been definitively granted, you will receive a yellow notice which you must display at the building site for public information. If no appeal is lodged, you may start the works from the 36th day after the notice has been displayed.
When do you need a solicitor?
A solicitor can help you if your planning permission application is refused, if someone objects to your project, or if you wish to challenge a neighbour’s planning permission. Furthermore, if you are unsure whether a planning permission is required or if you are in dispute with the local authority or other parties involved, legal advice can prevent many problems and delays.
