Faster and more efficient access to a lawyer thanks to improved Salduz-web

When someone is arrested and interrogated, it is crucial that they get quick access to legal assistance. Thanks to the updated version of Salduz-web, this is now handled even more efficiently. This digital platform, which supports police, court and lawyers, has been optimised to organise legal assistance during interrogation faster and more user-friendly.

What is Salduz?

The right to legal assistance during interrogation has its origins in a ruling by the European Court of Human Rights (ECtHR) in the case of Salduz v Turkey (2008). From this stemmed the European Directive 2013/48/EU, which states that every suspect has the right to a lawyer from the first interrogation. Belgium translated this principle into the Salduz Law, which has been in force since 2011 and has since been amended several times.

A more efficient and user-friendly system

Salduz-web has been an essential tool within the criminal justice system for years, guaranteeing that suspects can receive assistance from a lawyer during their interrogation. Advocaat.be has been a pioneer of this application since 2012 and continues to innovate to improve access to legal assistance.

The recent update brings important improvements:

  • Faster processing of files and assignment of lawyers, with the aim of assigning a lawyer to each file within 10 minutes.
  • Simplified registration of availability for lawyers, reducing waiting times for defendants.
  • A more intuitive and user-friendly interface for all parties involved.
The improvements to Salduz-web are more in line with the daily practice of lawyers, court and police. More efficient operation leads to better service and greater legal certainty.

Cooperation as key to success

The updated version of Salduz-web is the result of close cooperation between various judicial partners, including FPS Justice, the police, Customs & Excise, the judiciary and DPA. This cooperation has ensured more efficient alignment of processes and better practice.

Prompt and effective legal aid is a cornerstone of the rule of law. Everyone has the right to a fair trial and access to a lawyer is essential in this respect. Thanks to these improvements, this right will be even better guaranteed.

How does Salduz-web work?

The revamped Salduz-web ensures that suspects have timely access to a lawyer and that proceedings are conducted correctly. This is done in several steps:

  1. Registration of the suspect: The police register the suspect in Salduz-web and inform him or her of the right to legal assistance.
  2. Assignment of a lawyer: The suspect chooses his or her own lawyer or has one assigned. Minors and people with lower incomes can benefit from this assistance free of charge.
  3. Consultation interview: Before the interrogation, a confidential consultation takes place between the suspect and the lawyer, physically or in exceptional cases via telephone or video conference.
  4. Assistance during interrogation: The lawyer is present during the interrogation and can intervene when the suspect's rights are compromised.
  5. File management: Police, court and lawyers can consult the necessary information about the interrogation and assistance in Salduz-web.
